1. Application of the Terms
These terms (the “Terms”) apply to the services provided by Travalytics AB, 559527-2468, (“Travalytics”) to its customer (the “Customer”) (together the “Parties”) unless otherwise agreed in writing. By accepting these Terms, the Customer acknowledges and accepts all terms and conditions set forth below.
Unless the Parties agree otherwise, a binding agreement arises when the Customer accepts an offer issued by Travalytics at any given time. In the event of disagreement or contradiction between the Terms and any other order confirmation or written agreement between the Parties, the order confirmation or other written agreement shall prevail, unless the Parties have expressly agreed otherwise.
2. Scope of Service
Travalytics is a travel data analysis service offered in multiple tiers with varying features and pricing. It provides data collection via app or web survey, data processing, analysis, and reporting, as defined by the selected tier (the “Services”).
Travalytics’ Services are offered in three tiers: Lite, Classic, and Complete, with a separate service offered called Entry as a pre-study for Classic or Complete. The features and pricing are described below. A shorter summary is available at Travalytics - Get started.
The Customer's selected tier determines the specific deliverables included. Details of what each tiers features, pricing, and available add-ons are set forth below and form an integral part of this Agreement.
3. Travalytics Lite
The Travalytics Lite is the simplest tier which provides the Customer with a quick overview of travel to and from site, along with overall statistics of relevance. A Customer can only make one order of Travalytics Lite, for the avoidance of doubt a Customer with different departments can only order Travalytics Lite one time and the result will reflect the company as a whole.
Cost: Free. However optional extras are available.
Customer provides:
Number of employees
Number of employees in the company or the department
Email addresses of participants (with a signed GDPR agreement)
Date(s) for data collection (once the dates are ordered no changes can be made).
Contact person for project coordination
Travalytics provides:
Setup of the Travalytics survey (web or app depending on the Customers preference) with access codes
Onboarding materials for the organisation and for participants
One aggregate report per year (all employees in the same report) including mode share, emissions, physical activity, and more
One data collection per year (max 2 weeks per data collection)
Upgrade options:
A Customer that has selected Travalytics Lite can upgrade to Classic or Complete to access scenario modelling and departmental analysis. Costs for the upgrade will be agreed on in the order confirmation or in a written agreement.
Optional extras:
Support in recruitment or onboarding is available at 135 EUR/hour.
4. Travalytics Classic
This tier is a more extensive service where the Customers gets good quality baseline data, the possibility of before and after data to evaluate measures.
The cost for Travalytics Classic consists of a fixed cost and a cost based on the number of individuals in the survey population.
Maximum number of departments included in tier varies by size.
Detailed in the table below are the prices per year.

Scenario modelling, four pre-defined scenarios:
Shift x% of car trips to electric vehicles
Shift x% from car to active mobility
Shift x% from car to public transport
Shift x% from car to a combination of active mobility and public transport
Technical support function: response to questions from end users, during working hours 9-17 CET. Response within 2 working days.
Upgrade options:
A Customer that has selected Travalytics Classic can upgrade and receive aggregated data collected with different methods, changes to GDPR and/ or extra questions in background survey by upgrading to Travalytics Complete.
Costs for the upgrade will be agreed on in the order confirmation or in a written agreement.
5. Travalytics Complete
This tier is a complete analysis of the Customer’s travel data with several data collection methodologies.
The cost for Travalytics Complete consist of a fixed cost and a cost based on the number of individuals in the survey population.
Maximum number of departments included in tier varies by size.

6. Entry
A Customer can order a pre-study to Travalytics Classic or Travalytics Complete, see more information below. In this pre-study data is aggregated from several sites (locations to which travel is measured). If separate reports are required for different sites, each report must be ordered independently.
Flat cost: 500 EUR

Up to 4 predefined scenarios:

Impacts on CO2e emissions, health impacts and monetary value, changes to fuel costs.
Travalytics provides:
A report with estimated impacts and potential of each selected scenario.
7. Add-On Pricing
Below is information on add-on’s available on each tier if not specifically stated. Each add-on most be agreed on and included in the order confirmation or in the written agreement.

8. Period of Validity and Termination
Unless otherwise agreed in the order confirmation or in the written agreement, these Terms shall apply from the date stated in the order confirmation or in the written agreement and remain in effect for a period of 12 months. The agreement will automatically be renewed on an annual basis unless terminated in writing by the Customer no later than 30 days prior to the renewal date.
Either party may terminate the Terms including the order confirmation and any other written agreement without penalty prior to the start of data collection. If the Customer withdraws after data collection has commenced, Travalytics will have no further obligation to deliver the report or refund any fees already paid unless otherwise agreed in writing.
A Party may, by written notice, terminate the engagement with immediate effect if the other party breaches the Terms or the order confirmation or any other written agreement, and such deviation is of material significance and a possible correction has not been made within 30 days after the party has requested correction in writing.
9. Pricing
Unless specifically agreed in the order confirmation or any other written agreement, the following shall apply to fees, additional taxes and charges etc. All prices are exclusive of any applicable taxes which will be added as required by law.
Prices for the Services are based on an annual service period and apply per 12-month cycle starting from the date stated in the order confirmation or any other written agreement. Travalytics has the right, as regards ongoing engagements, to make such price adjustments as can be attributed to general changes in prices or costs.
In addition to the price, the Travalytics is entitled to compensation for disbursements and expenses in connection with the Services such as disbursements for travel and board and lodging.
10. Payment Terms
The following shall apply, unless otherwise agreed in the order confirmation or in any other written agreement. Travalytics shall invoice the Customer at the date stated in the order confirmation or any other written agreement. The Customer shall provide payment not later than 30 days from date of invoice. In the event of delay in payment, penalty interest shall be payable in accordance with the Interest Act (1975:635).
If the Customer fails to pay an invoiced amount on time, Travalytics is entitled to immediately discontinue the Services until the outstanding amount has been paid in full, and Travalytics will then be free of liability for any delay or other damage which may result from the discontinuation. Travalytics is entitled to terminate the Terms including the order confirmation and any other written agreement with immediate effect if the Customer has not paid an amount due and more than 30 days have passed since a payment reminder.
11. Data Use and Privacy
We process personal data in connection with the Travalytics Services in several ways, depending on context:
(a) Customer Account and Order Information
We collect and process personal data about individuals placing orders for Travalytics, including contact details, billing information, and communications, for the purpose of managing Customer accounts, invoicing, customer support, and our internal business operations. This data is controlled and processed by us in accordance with applicable data protection laws. Details of this data processing agreement are available at https://travalytics.io/privacy-policy
(b) Participant Contact Data (e.g. Email Addresses for Invitations)
For some Travalytics applications, the Customer may provide us with lists of email addresses or other identifiers of participants to facilitate survey invitations or app onboarding. Travalytics process this data solely on behalf of the customer, for the purpose of delivering the agreed service. Travalytics do not use participant contact data for any other purpose, do not share it with any third party except as required to deliver the service (e.g. email service providers), and delete it in accordance with our data retention policies after project completion. Additionally, Travalytics never cross-correlate data on participants with data collected on travel habits through web survey or Travalytics app. A separate agreement is in place regarding the management of this data when applicable.
(c) Travel Data Collected via Travalytics
Data collected through the Travalytics Services (via app or web survey) is used to produce aggregated and anonymised reports for the customer. Individual-level travel data is processed solely to deliver these analytics services and is never shared with any third party, including the Customer itself, in identifiable form. All data collection and processing comply with applicable data protection laws, including the General Data Protection Regulation (GDPR). Customers selecting the tier Travalytics Complete may receive customised GDPR agreements as part of the service. In this case changes can only be made to reduce level of sharing, not increase it. Only changes can be made that can be implemented in legal text at https://travalytics.io/privacy-policy-app which will not require changes in Travalytics app. One feedback round included. GDPR customisation may also be purchased as an add-on for other tiers, subject to availability and agreement.
12. Limitations
The Service is provided as described for each tier, without any warranty of specific outcomes or suitability for a particular purpose.
Travalytics does not warrant uninterrupted or error-free operation of the Services. Insights derived from aggregated or analysed data from the Services are indicative only and are not intended as specific recommendations for action.
Damage shall be compensated for by Travalytics only if Travalytics has acted negligently or willfully. Travalytics is in no case liable for loss of production, lost profit or any other indirect damage or consequential harm of any kind. Travalytics liability for any claim arising from use of the Service is limited to the amount paid by the Customer for the Services for the ordered tier.
The Customer shall promptly lodge a written complaint with Travalytics for such faults or deficiencies in the execution of the Services or part of the Services as the Customer discovers or ought to have discovered. The complaint shall contain clear information on the nature and extent of the fault or deficiency. After a complaint or adverse observation has been made, Travalytics shall be granted an opportunity to remedy the fault or deficiency within reasonable time – if possible – prior to the Costumer demanding compensation. The right of the Customer to damages or remedial according to this section is forfeited if the complaint is not made within a reasonable time. The Customer does not have the right to withhold fees that are not directly related to the complaint or otherwise fail to fulfil its undertakings.
13. Force Majeure
Travalytics is not liable for damage resulting from Swedish or foreign law or from or from action of an authority, act of war, terrorism, IT attack, strike, blockade, boycott, lockout, pandemic, fire or other accident, natural disaster or disruption to IT, telecommunications or electricity distribution or any other similar circumstance which could not have been predicted. With regard to strike, blockade, boycott and lockout, the reservation also applies if Travalytics is itself the object of or takes such conflict action.
14. Intellectual Property Rights
Travalytics retains the right of ownership of all intellectual property rights, both held prior to entering into the agreement with the Customer and developed during the period of validity. The Customer may, however, make use of the result of the Services.
15. Confidentiality
The Parties undertake to observe confidentiality and not to unwarrantably disclose to any third party during the term of the Services and for 12 months thereafter, any information about the other Party’s business that may be regarded as a trade or professional secret. Information which is confirmed by a Party to be confidential when provided shall always be regarded as confidential. The Parties undertake to use such trade or professional secrets only to the extent necessary to perform the Services.
The confidentiality undertaking under the preceding paragraph does not apply to
information that a Party can show became known to it in a manner other than by, or in conjunction with, performance of the Services; or
information that is public knowledge or becomes public knowledge without breach of the confidentiality undertaking in these Terms and the order confirmation or any other written agreement; or
information that a Party is legally obliged to disclose.
16. Applicable Law
Swedish law, with the exception of the rules on choice of law, shall be applicable to these Terms and the Services.
17. Disputes
Disputes arising from the Services shall be subject to the exclusive jurisdiction of the Swedish Courts.
